Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Hosanna mobile application and related services (collectively, the “Services”) provided by Hosanna / Faith Comes By Hearing (“FCBH,” “we,” “us,” or “our”).

By downloading, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

Important Consumer Notice

Some jurisdictions provide consumers with non-waivable rights, including certain rights related to digital services, refunds, and limitations of liability. Nothing in these Terms is intended to exclude or limit any rights you may have that cannot be waived under applicable law.

Description of the Services

Hosanna provides access to Bible, Scripture, ministry, and related content, including text, audio, video, films, film clips, thumbnails, captions or subtitles where available, sharing links, search, offline access where available, and account features. Some content is owned by or licensed from third parties and may be subject to additional restrictions, attribution requirements, language availability, territory limitations, technical limitations, or partner requirements.

Video and film content may include content made available by or through FCBH, Bible Media Group, Jesus Film Project, or other licensors, partners, or content providers. The exact content available may change over time.

We may add, change, suspend, remove, geoblock, limit, or discontinue any part of the Services or any specific content at any time, including due to licensing, partner requirements, rights restrictions, technical limitations, legal requirements, or availability in particular countries, regions, languages, or devices.

Eligibility

The Services are not directed to children under 13. If you are under 13, do not use the Services. If you are 13 or older but under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the Services.

In some jurisdictions, higher age thresholds may apply. You are responsible for ensuring you are legally permitted to use the Services where you live.

Accounts and Authentication

You may be able to use the Services without creating an account, but some features may require authentication.

When you create or access an account, you agree to provide accurate information and to maintain the security of your account credentials. If you use third-party sign-in (Apple, Google, or Facebook), your use is also subject to that provider’s terms and policies.

Account Deletion

If you create an account, you may be able to delete it from within the App where the feature is available and/or by contacting us using the contact information below. Deleting an account is intended to remove the account from our records and delete or deidentify personal information associated with the account, subject to legal requirements and permitted retention as described in our Privacy Policy.

Deleting your account may not automatically delete support tickets, support communications, security logs, legal records, or other information that may be retained as described in our Privacy Policy. You may separately request deletion of support information, subject to legal requirements, security needs, and permitted retention.

Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services and access content made available through the Services for your personal, non-commercial use, subject to these Terms and the Services’ intended functionality.

You may not (and may not encourage others to):

• use the Services in any way that violates any applicable law or regulation;
• copy, reproduce, duplicate, archive, upload, distribute, publicly perform, publicly display, modify, translate, adapt, create derivative works from, sell, sublicense, broadcast, transmit, retransmit, or otherwise exploit any content or portion of the Services except as explicitly permitted through the Services’ intended functionality;
• record, screen-capture, rip, download, extract, export, save, or redistribute audio, video, film, thumbnails, subtitles, captions, media URLs, manifests, HLS segments, filesets, or metadata except as explicitly permitted through the Services’ intended functionality;
• remove, obscure, or alter any copyright, trademark, attribution, licensing, rights-management, or proprietary notice;
• attempt to gain unauthorized access to the Services or related systems, or interfere with the Services’ operation, including by introducing malware or engaging in denial-of-service attacks;
• scrape, crawl, harvest, index, or use automated means to access the Services or extract content, metadata, filesets, media URLs, or other content-delivery resources except as allowed by us in writing;
• circumvent, disable, bypass, or interfere with security, access-control, geographic, license, or technical restrictions;
• reverse engineer, decompile, or otherwise attempt to extract source code from the Services except to the extent such restriction is prohibited by law.

Intellectual Property

The Services, including the software, design, and other components, are owned or licensed by FCBH and are protected by U.S. and international intellectual property laws. All rights not expressly granted are reserved.

Names and logos associated with Hosanna and FCBH are trademarks and/or copyrights of FCBH. Third-party names, logos, titles, trademarks, film names, series names, and content, including those associated with Bible Media Group, Jesus Film Project, and other licensors or partners, belong to their respective owners.

Video and Third-Party Licensed Content

Some Bible, Scripture, audio, video, film, image, subtitle, caption, and related content available through the Services is owned by or licensed from third parties. This may include content associated with LUMO Project Films, Bible Media Group, The Gospel Films, The Covenant, Acts of the Apostles, and other licensors, partners, or content providers.

Unless expressly allowed by the Services’ intended functionality or by written permission from FCBH or the applicable rights holder, you may not copy, download, stream outside the Services, capture, screen-record, reproduce, duplicate, archive, upload, modify, translate, adapt, create derivative works from, publish, broadcast, transmit, retransmit, distribute, publicly perform, publicly display, sell, sublicense, or otherwise exploit any content available through the Services.

You may not remove, obscure, or alter any copyright, trademark, attribution, licensing, watermark, rights-management, or proprietary notices associated with any content. You may not attempt to extract, scrape, capture, index, harvest, or reuse media URLs, manifests, HLS segments, thumbnails, captions, subtitles, metadata, filesets, or other content-delivery resources except as expressly permitted through the Services’ intended functionality.

Where offline access or downloads are made available through the App, they are provided only for personal, non-commercial use within the App, subject to these Terms, technical controls, license restrictions, expiration, removal, and availability. Offline access does not transfer ownership of any content and does not permit export, redistribution, public performance, broadcast, retransmission, or use outside the App.

All third-party names, logos, titles, trademarks, and content are the property of their respective owners. Availability of third-party content through the Services does not imply endorsement by any third party unless expressly stated.

User Content

At launch, Hosanna is not intended to provide public community posting, and user-generated public content may not be available. If we later enable features that allow you to create or store content (such as reading plans, notes, bookmarks, highlights, or other content), then:

• You retain ownership of your content as between you and us.
• You grant us a license to host, store, reproduce, and display your content solely to operate the Services and provide the feature to you (and, if you choose to share it, to facilitate that sharing).

You agree not to submit content that is unlawful, infringing, harmful, or violates the rights of others.

Reliance on Information, Translations, and Film Adaptations

Content made available through the Services is provided for personal, educational, devotional, ministry, and general informational purposes. Bible translations, audio recordings, videos, films, film clips, subtitles, captions, descriptions, and related materials may be provided by FCBH, licensors, partners, or other content providers.

We do not warrant the accuracy, completeness, availability, theological interpretation, historical depiction, translation, captioning, subtitling, synchronization, or usefulness of any content. Bible translations and licensed content are provided by or through their respective licensors and content providers. Any reliance you place on content available through the Services is at your own risk.

Third-Party Links and Services

The Services may include links to third-party websites or services, including donation pages, support pages, partner content, external video services, or other resources. We do not control third-party sites or services and are not responsible for their content, availability, security, terms, privacy practices, or other practices.

If you choose to open or use a third-party website, player, endpoint, support resource, donation page, or service, your use is at your own risk and may be subject to that third party’s terms and policies. The inclusion of any link or third-party resource does not imply approval or endorsement by FCBH unless expressly stated.

Donations

If the Services include a donation link or button, donating is handled outside the App in your browser or on a third-party page. The App does not process payment card information.

Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES (INCLUDING ALL CONTENT AND FUNCTIONALITY) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR SERVERS ARE FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow exclusion of certain warranties, so some exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FCBH, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FCBH, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR DAMAGES ARISING OUT OF OR RELATING TO CONTENT UNAVAILABILITY, CONTENT REMOVAL, SERVICE INTERRUPTIONS, DEVICE OR NETWORK ISSUES, THIRD-PARTY WEBSITES OR SERVICES, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT RESULTING FROM YOUR FAILURE TO PROTECT YOUR ACCOUNT CREDENTIALS.

BECAUSE THE SERVICES ARE PROVIDED FREE OF CHARGE AND DONATIONS, IF ANY, ARE HANDLED OUTSIDE THE APP AND ARE NOT PAYMENTS FOR USE OF THE SERVICES, SOME REMEDIES COMMONLY ASSOCIATED WITH PAID DIGITAL SERVICES MAY NOT APPLY.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify, and hold harmless FCBH, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Services.

Governing Law and Jurisdiction

Except to the extent prohibited by applicable consumer protection laws, all matters, disputes, or claims relating to the Services and these Terms shall be governed by and construed in accordance with the internal laws of the State of New Mexico without giving effect to any choice or conflict of law provision or rule.

Except where prohibited by applicable law (including laws that permit consumers to bring claims in their local courts), any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted in the federal courts of the United States or the courts of the State of New Mexico in each case located in Albuquerque, Bernalillo County, New Mexico. You waive any objections to jurisdiction or venue in such courts to the extent permitted by law.

Changes to the Terms

We may update these Terms from time to time. Changes are effective when posted or as otherwise stated. If we make material changes, we may provide additional notice where required by law or where we consider it appropriate, such as through the App, on our website, or by other reasonable means. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

Termination

We may suspend or terminate access to the Services at any time if we believe you have violated these Terms, if required by law, or to protect the security or integrity of the Services. You may stop using the Services at any time.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later. Any waiver must be in writing to be effective.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms, notices, or restrictions presented in the Services or made available with specific content, constitute the entire agreement between you and FCBH regarding the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties regarding the Services.

Survival

Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, permitted use and content restrictions, third-party licensed content, disclaimers, limitations of liability, indemnification, governing law, jurisdiction, severability, no waiver, and entire agreement.
